Ukraine and the EU have introduced alternative rules of origin for goods

Since December 1, 2023, Alternative rules of origin of goods will be introduced at the bilateral level between Ukraine and the European Union. The alternative rules of origin contain some innovations compared to the current version of the rules of origin of the Regional Convention on Pan-Euro-Mediterranean Preferential Rules of Origin.

In particular, the agreement provides for the appearance in the Harmonized System of description and coding of goods of new terms "interchangeable goods", "maximum content of materials originating from third countries", "groups" and "positions". The list of goods that are completely obtained in the countries participating in the Convention has also been updated.

The use of only two documents for proof of origin is envisaged: the EUR.1 certificate and the declaration of origin instead of four (excluding EUR-MED documents), which will simplify the procedure for proving the origin. The validity period of origin documents has been increased from 4 months to 10.

The list of documents required to confirm the origin of materials/raw materials used in the production of finished goods has been clarified, in particular, the supplier's declaration and the supplier's long-term declaration. The mechanism for granting the status of an authorized (approved) exporter has also been simplified.
