The new legislation in the field of trade protection will be adapted to EU norms and will protect the interests of the Ukrainian producer

The Cabinet of Ministers of Ukraine has approved draft laws that adapt Ukrainian legislation in the field of trade protection to EU regulations and enhance protection, in particular, of national producers. The Government supported the relevant decisions at the meeting on November 24, 2023.

Thus, the Government has approved the draft laws:

"On protective measures". It is supposed that the new version of the Law of Ukraine "On the Application of Special Measures Regarding Import to Ukraine" will be published.

"On Protection from Dumping Import" (new edition of the Law of Ukraine "On Protection of National Producers from Dumping Import").

"On Protection from Subsidized Import" (new version of the Law of Ukraine "On Protection of National Producers from Subsidized Import").

The draft laws contain norms that, in particular:

expand the capacities of national producers in protecting their interests from unscrupulous and growing import;

reduce business costs for the preparation of materials and documentation during defense investigations;

establish clear time limits for procedural stages of investigations;

guarantee consultations at the request of the interested party;

introduce a mechanism that will guarantee the payment of preliminary protective duties or duties during the investigation of their evasion;

expand the circle of "users" of this mechanism among businesses, etc.

Also, the draft laws specify the powers of the competent authorities when conducting investigations, introduce a rule regarding the Government's approval of the regulations on the Interdepartmental Commission on International Trade, improve the conceptual apparatus, etc.
